What is required for someone to be held criminally responsible for undertaking the temporary supervision of a child?

A father asked his adult son to look after three younger siblings who were on a bathing jetty while the father temporarily left them to take care of another sibling. One of the siblings, who was three years old at the time, fell into the water and almost drowned.

The drowning incident gave rise to the question of what is required for someone to be considered to have undertaken the temporary supervision of a child in such a way that criminal liability may arise in the event of deficiencies in supervision. The Supreme Court has assessed that it is required that the person who assumes responsibility has the ability to cope with the task and that he or she has also understood the meaning of his or her commitment.
